- Classify the worker correctly. The IRS looks at behavioral control, financial control and the relationship of the parties to decide whether someone is an employee or an independent contractor (IRS guidance).
- Collect a Form W-9. The IRS says the first step is to have the contractor complete Form W-9 so you have their correct name and taxpayer identification number (IRS forms for independent contractors).
- Generally, no withholding. You generally do not have to withhold or pay taxes on payments to independent contractors. If a contractor has not provided their TIN as required, you must apply backup withholding at 24%.
- File Form 1099-NEC at $2,000 or more. For payments made in 2026 and later, file a 1099-NEC for each contractor you paid at least $2,000 during the year. The threshold was $600 through 2025 and may be adjusted for inflation beginning in 2027. Commissions go in box 1a as nonemployee compensation (IRS Instructions for Forms 1099-MISC and 1099-NEC).
- Meet the January 31 deadline. Form 1099-NEC is due to the IRS and to the contractor by January 31. If you file 10 or more information returns in a calendar year, you must e-file.
